The Planning Department serves as the first point of contact for new construction in the City of Fulshear. Whether you are building a commercial building, building a new home, or renovating/adding to your home, the staff in the planning office will assist residents and patrons with any construction project.

Codes

Building Codes

The City of Fulshear has adopted the 2015 International Codes, including Building, Residential, Property Maintenance, Energy, Mechanical, Fuel Gas, and Plumbing, as well as the 2014 National Electrical Code, as amended per Ordinance. The city enforces these codes and the technical standards they reference. To obtain building permits or certificates of occupancy, compliance with Fulshear design standards and development codes are required.

Fire Code is per Fort Bend County Fire Marshal.


Required

Within the City of Fulshear city limits and the city's extraterritorial jurisdiction (ETJ), any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system (the installation of which is regulated by the International Building Code), or to cause any such work to be done, including all signs, shall first make application to the Building Official and obtain the required permit.

All contractors who work within the City of Fulshear city limits must register as a contractor, provide the city with a copy of the contractor license, driver's license and a minimum of $1,000,000 general liability insurance with the City of Fulshear listed as an additionally insured. The registration fee is $200.00.


Exempt Work

Permits shall not be required for improvements such as the following:

BUILDING: Fences not over 6 ft., painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work, swings and other playground equipment.

ELECTRICAL: Repairs and Maintenance for minor repair work such as the replacement of lamps or the connection of approved portable electrical equipment to approved permanently installed receptacles.

GAS: replacement of any minor part that does not alter approval of equipment or make such equipment unsafe.

MECHANICAL: Portable heating appliances, portable cooling units, replacement of any minor part that does not alter approval of equipment or make such equipment unsafe.

Exemption from permit requirements of the International Building Code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of the Code or any other laws or ordinances of the City of Fulshear.

Work without a Permit

Any contractor who has done work without the required building permit will be fined $350.00 (additional fees may be assessed.) The paying of this fee shall not relieve any person from fully complying with the requirements in the execution of the work nor from any other penalties prescribed in the Code.

Pool and Spa Drainage

The City of Fulshear has enacted Ordinance 2025-1505 to safeguard local water quality and the environment. This ordinance mandates that residents and property owners adhere to proper procedures when draining pools or spas, preventing harmful chemicals from entering storm drains, creeks, or neighboring properties. To comply, you have two options for discharging your pool or spa water:

  1. Direct the water into the storm drain system.
  2. Slowly discharge the water onto your lawn, ensuring it remains on your property and slowly runs off into the street or drainage system.

Absolutely no draining into the sanitary sewer systemResidents must provide the City of Fulshear written notice at least 24 hours before draining a pool or spa.

The notice must include your full name and property address. Notices can be submitted by email to Inspections@FulshearTexas.Gov or delivered in person at Fulshear City Hall. These measures are designed to protect our community's waterways and ensure environmental safety.

The Planning Department accepts cash, checks and credit cards, including Visa, MasterCard, and Discover. Please note there is a 3% convenience fee for the use of all credit/debit cards as a form of payment.
